Terms and Conditions
These terms are provided by 545 WYN OWNER, LLC, the owner of the building known as 545wyn, and its property manager Goldman Properties (together, "545wyn," "we," "us" or "our"). Part A covers the 545wyn Building Notifications text message program. Part B covers use of the 545wyn.com website. Our Privacy Policy explains how we handle personal information.
Part A. 545wyn Building Notifications: SMS Terms
Summary. 545wyn sends informational text messages about the building at 545 NW 26th Street, Miami, FL. Message frequency varies, up to 20 messages per month. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Consent is not a condition of any lease, employment, occupancy or building access. No mobile information will be sold or shared with third parties for promotional or marketing purposes.
1. Program description
The 545wyn Building Notifications program (the "Program") is operated by 545wyn Building Management through our building management system. We send recurring automated informational text messages about:
- building operations, maintenance and service interruptions;
- access, security, emergency and life safety alerts;
- package and delivery notices; and
- visitor passes and visitor arrival notifications.
The Program does not send marketing or promotional messages.
2. Who receives messages and how you opt in
Occupants. People who work in the building are enrolled in two steps. First, their employer (the tenant) elects to participate under Article 38 of its lease by checking an unchecked box and initialing it. Second, each individual signs the one-page Occupant Text Message Authorization (Exhibit K to the lease) with an unchecked consent box. Building Management enters a mobile number only after that signed form is on file. You will receive a confirmation text when you are enrolled. Copies of both forms are shown below.
Visitors. When an Occupant creates a visitor pass, the Occupant asks the visitor, by phone or in person:
"Can 545wyn text your visitor pass to this number? Message and data rates may apply, and you can reply STOP to opt out."
The visitor's number is entered only after the visitor says yes, and the Occupant confirms that agreement in the building management system. Visitors receive only the pass and the arrival or expiration notices for that visit, and are not enrolled in recurring messages.
Consent to receive text messages is voluntary. It is not a condition of any lease, employment, occupancy, visit or building access. If you do not participate, we will send building notices by email, the building app or other means.
3. Message frequency and cost
Message frequency varies with building activity and visitor registrations, typically up to 20 messages per month per number. Message and data rates may apply according to your mobile plan. We do not charge for the Program.
4. How to opt out
Reply STOP to any 545wyn message at any time. STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work. You will receive one confirmation that you have been unsubscribed, and no further messages will be sent to that number. You may also ask Building Management to remove your number. To rejoin, reply START or contact Building Management.
If you opt out, you will no longer receive emergency or security alerts by text. Those alerts will still be sent by other means.

7. Carriers and delivery
Supported carriers include major US wireless carriers. Wireless carriers are not liable for delayed or undelivered messages. Text messages can be delayed or not delivered for reasons outside our control, so do not rely on the Program as your only source of emergency information. In an emergency, follow building alarms, staff instructions and directions from emergency services, and call 911.
8. Your number
Tell Building Management if you change or give up your mobile number, or if you leave your job at the building, so we can remove it. You confirm that you are the account holder or regular user of any number you enroll.
9. Privacy
We use mobile numbers and consent records only to operate the Program. No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except service providers that deliver messages on our behalf. See our Privacy Policy.
10. Changes to the Program
We may change or end the Program at any time. We will post changes on this page and, for material changes, notify enrolled numbers by text.

Part B. Website Terms of Use
1. Acceptance
By using 545wyn.com (the "Site"), you agree to these terms. If you do not agree, do not use the Site.
2. Information only
The Site provides general information about the building and available space. Floor plans, square footages, renderings, amenities, availability and other details are approximate, may change without notice, and are not an offer to lease. Only a written lease signed by the owner and the tenant is binding.
3. Permitted use
You may view and download Site content for your own business evaluation of the building. You may not copy, republish or sell Site content; scrape or harvest data from the Site; interfere with its operation or security; or use it for any unlawful purpose.
4. Intellectual property
The Site and its content, including the 545wyn name and logo, photographs, renderings and text, are owned by or licensed to us and are protected by copyright and trademark law. Artwork shown on the Site may be owned by the artists who created it.
5. Third-party links
The Site links to other sites, such as Goldman Properties and our leasing brokers. We are not responsible for their content or practices.
6. Disclaimer
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR THE PROGRAM. This section does not limit any obligation under a signed lease.
8. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida.
9. Changes
We may update these terms by posting a new version on this page with a new "Last updated" date. Continued use of the Site after a change means you accept it.
